Welcome to Duncan's Coin Shop ("the Store," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "Buyer," "User," or "you") and Duncan's Coin Shop governing your access to and use of our website, catalog, checkout systems, customer support, and all associated services.

By accessing our website, creating an account, browsing listings, placing an order, or initiating checkout via PayPal or any other payment method, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms. If you do not agree to every provision of these Terms, you must immediately discontinue use of this website and refrain from placing orders.

Eligibility: You must be at least 18 years of age or the age of legal majority in your jurisdiction to place orders or make purchases through our store. By placing an order, you represent and warrant that you possess the legal authority to enter into binding contracts.

We take pride in our numismatic expertise and curate historical coins, ancient artifacts, tokens, and precious metals with rigorous diligence.

Subjectivity of Numismatic Grading:

• Numismatic condition grading (including standards such as Poor, Fair, Good, Fine, Extra Fine, About Uncirculated, Mint State, and numerical Sheldon 1–70 ratings) represents an educated subjective opinion and does not constitute an absolute empirical or scientific guarantee.
• Third-party certified coins (such as those encapsulated by PCGS, NGC, ANACS, or PMG) are sold strictly according to the grade assigned by the certification service. We make no warranty that another grading agency would assign an identical grade or attribution.
• For uncertified ("raw") items, all grade assessments, strikes, toning descriptions, and designations are professional appraisals offered in good faith based on industry guidelines.
• Photographs & Visual Differences: We strive to provide high-resolution, accurate photography. However, due to metallic reflectivity, natural luster, device screen color calibrations, lighting variations, and optical magnification, actual coin appearance, strike depth, toning hues, and patina may exhibit slight differences when viewed in person.

Precious metals, including gold, silver, platinum, palladium, and bullion coins/bars, are commodities subject to rapid and volatile price fluctuations determined by global financial markets, spot exchanges, and supply/demand forces.

Clerical & Typographical Errors: While we endeavor to ensure all pricing, specifications, and descriptions are accurate, errors may occasionally occur. Duncan's Coin Shop reserves the right to correct any clerical, typographical, computational, or technical errors at any time without prior notice.

Right to Refuse or Cancel Orders: We reserve the right to cancel or refuse any order placed for items listed at an incorrect price, whether due to system error, typographical mistake, or inventory desynchronization. If your payment has already been processed for a canceled order, we will promptly refund the full transaction amount via the original payment method.

Inventory Limits: Because many numismatic specimens are unique, one-of-a-kind (single inventory) items, availability is subject to prior sale. If multiple customers simultaneously purchase the same one-of-a-kind item, the sale will be fulfilled to the earliest successfully completed order, and any subsequent orders will be immediately canceled and fully refunded.

Payment Methods: We accept payments through PayPal, major credit and debit cards processed through authorized gateways, and authorized promotional discount vouchers. All charges are denominated in United States Dollars ($USD).

Fraud Screening & Security: To protect both our customers and our business against fraudulent activity, all transactions are subject to automated and manual anti-fraud screening. We reserve the absolute right to:

• Request supplementary identity or address verification prior to dispatching high-value orders;
• Require orders to ship strictly to the verified PayPal or billing address on file;
• Cancel and refund orders deemed high-risk by automated payment security algorithms or that exhibit suspicious transaction indicators.

Contract Formation: The receipt of an electronic order confirmation or payment notification signifies receipt of your order request, not final acceptance. Final contract formation occurs only upon packaging and transfer of the ordered items to the carrier.

Shipping Methods & Rates: Orders are dispatched using the United States Postal Service (USPS) or other reputable commercial carriers. Shipping fees and thresholds (such as Free US Shipping on qualifying multi-item orders over $50) are calculated and displayed on the Cart page prior to checkout.

Risk of Loss & Carrier Delivery:

• All shipments include carrier tracking numbers. Once a carrier scans a package as "Delivered" to the designated address, delivery is legally complete.
• In the event of damage sustained during transit, the buyer must notify us within 48 hours of receipt and retain all original packaging materials, mailing envelopes, and contents for carrier inspection and insurance claims.
• We are not responsible for carrier transit delays resulting from severe weather, postal disruptions, customs inspections, or holiday volume spikes.

International Orders & Customs Duties:

• International shipments may be subject to import duties, value-added taxes (VAT), goods and services taxes (GST), and customs clearance brokerage fees imposed by the destination country's government.
• All such import fees, taxes, and clearance duties are the sole and exclusive responsibility of the buyer. We will not falsely declare items as "gifts" or undervalue shipments on customs documentation under any circumstances.

Your satisfaction is important to us. We offer a fair and transparent return process for qualifying numismatic collectibles.

Return Requests: If you wish to request a return for an eligible item, please contact our Support Desk with your order details and reason for return.

Non-Returnable Items:

• Precious metals bullion items, bullion rounds, ingots, and bars (due to market price fluctuations);
• Custom orders, tip/donation contributions (Item #57), and items sold as "As-Is / Final Sale";
• Digital delivery items or vouchers once redeemed.

Return Shipping & Refunds: Return shipping costs are the responsibility of the buyer, using a trackable and insured shipping service. Upon receipt and successful inspection of the returned item, a refund for the item purchase price (excluding original shipping charges) will be issued to the original payment method within 3 to 5 business days.

"As Is" Disclaimer: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SITE, SERVICES, AND ALL PRODUCTS SOLD ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

Limitation of Damages: IN NO EVENT SHALL DUNCAN'S COIN SHOP, ITS OPERATORS, EMPLOYEES, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR INVESTMENT ANTICIPATIONS, ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR SERVICES, WEBSITE OPERATION, OR ANY PRODUCTS PURCHASED.

Liability Cap: UNDER NO CIRCUMSTANCES SHALL DUNCAN'S COIN SHOP'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO ANY ORDER OR DISPUTE EXCEED THE ACTUAL PURCHASE AMOUNT PAID BY THE BUYER FOR THE SPECIFIC ITEM GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit the exclusion of certain warranties or limitations on liability; in such jurisdictions, our liability shall be limited to the maximum extent permitted by governing law.

By using this website, you represent and agree that you will not:

• Submit false, fraudulent, or unauthorized payment information or use stolen accounts;
• Attempt to bypass, test, or breach site security, firewall configurations, rate limits, or backend databases;
• Deploy automated scrapers, spiders, robots, or data harvesting scripts against the site without express written consent;
• Submit abusive, defamatory, threatening, or spam messages to our Support Desk or communication channels;
• Engage in fraudulent chargebacks or dispute filings where goods have been verifiably delivered in accordance with these Terms.

We reserve the right to suspend or terminate accounts, refuse service, and block IP addresses of individuals who violate these rules.

All content included on this website—including coin photographs, item descriptions, graphic assets, logos, button icons, audio/visual elements, page designs, and site code—is the proprietary property of Duncan's Coin Shop or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

No content from this site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any manner without prior express written permission from Duncan's Coin Shop.

Informal Resolution: Before initiating any formal legal claim or arbitration, you agree to contact us in writing through our Support Desk with a detailed summary of the issue. Both parties agree to negotiate in good faith to resolve the matter amicably within thirty (30) days.

Governing Law: These Terms and any dispute or controversy arising out of your relationship with Duncan's Coin Shop shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Severability: If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement: These Terms, together with any order confirmation and relevant published store policies, constitute the complete agreement between you and Duncan's Coin Shop regarding store transactions.
